Bira has received lots of question from members about the recent Supreme Court ruling on insurance claims, and whether this would apply to the members’ policies. To help members we have developed a partnership with a local solicitor who has great knowledge in this area. This legal company, RLK Solicitors, has developed a ‘portal’ that allows you to submit the relevant information. On receiving this, the solicitors will review your policies and assess the possibility of a successful claim.

The deadline for your application to this legal portal is the 8th March. Please make sure that you have all the information ready (your insurance schedule and the policy wording at the time of the first lockdown – e.g. March 2020) when you start the application. It will not take long to complete.

If you haven't claimed, you really should.   Here's why...

We know there has been one court ruling in favour of policy holders. There is also a strong possibility that other aspects of insurance policies are being looked at by legal experts and policy holders, with a view to challenging the insurers' decision not to pay out.

With this in mind, it is important for the policy holder to make a formal claim before the 22^nd March 2021 (anniversary of the first lockdown) if the business feels it should have been able to claim on any aspect of their policy. The insurance company may well say no, but if there is a new court ruling later in the year, then businesses that have previously lodged a claim could challenge the decision of the insurer not to pay.   In summary, even if you do not feel you qualify for a claim under this court ruling, it would still be prudent to make a formal claim which may become relevant in the future.
